Terms of Service
This page describes what Inkling is and is not, how you may use it, and where responsibility lies. By using Inkling — including the TestFlight beta — you agree to these terms.
Beta period
Inkling is currently in TestFlight beta. The app, its content, and these terms may change without notice. By participating in the beta, you accept that the experience is unfinished, may contain bugs or rough edges, and may evolve substantially before public launch. We welcome and rely on your feedback.
What Inkling is and is not
Inkling administers validated psychometric screening instruments and provides AI-generated interpretation of the results. It is an orientation tool.
Inkling is not a diagnostic tool, medical device, telehealth service, or therapy. It is not a substitute for evaluation by a qualified clinician. The results it produces are educational. Treat them as information that may inform your next conversation with a professional, not as a clinical opinion.
Who can use Inkling
To use Inkling you must be at least 18 years of age, located in a jurisdiction where the screening instruments and AI services Inkling uses are legal to access, and mentally competent to provide informed consent. The age gate at first launch enforces the age requirement.
How you can use Inkling
For your own personal, non-commercial use. Don't use Inkling to screen anyone other than yourself. Don't share your results out of context — they're easy to misread without their accompanying interpretation. Don't reverse-engineer, decompile, scrape, or interfere with the app or our infrastructure.
Crisis routing
Inkling watches the text you write for indicators of acute distress, and if it sees them, redirects you to crisis resources (988 in the US, Crisis Text Line, the Trevor Project for LGBTQ+ youth, and others). This redirection is a software suggestion, not an emergency intervention.
Specifically:
- Inkling does not automatically contact emergency services on your behalf.
- Inkling does not notify your family, healthcare providers, or anyone else.
- The responsibility to seek emergency help in a true crisis remains with you or those around you.
If you or someone near you is in immediate danger, call 911 (US) or your local emergency services.
Disclaimer of warranties
Inkling is provided "as is," without warranty of any kind, express or implied. We make no warranty regarding accuracy, completeness, fitness for a particular purpose, or non-infringement. The screening instruments are validated within the populations published in their original research; their interpretation outside those populations is not guaranteed. AI-generated interpretation is not a clinical opinion and may contain errors.
Limitation of liability
To the maximum extent permitted by law, Inkling and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, use, goodwill, or other intangible losses — arising from your use of Inkling. This includes any reliance you place on AI-generated interpretations or screening results, and any clinical, psychiatric, or psychological outcomes you experience.
Termination
You may stop using Inkling at any time by deleting the app from your device. We may terminate or restrict your access at any time, with or without notice, for any reason, including violation of these terms.
Changes to these terms
We may update these terms at any time. Material changes will be communicated via in-app notice or, during the TestFlight beta period, directly to active testers. Continued use after a change constitutes acceptance.
Governing law
These terms are governed by the laws of the State of Nevada, United States, without regard to its conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Clark County, Nevada.
Severability
If any provision of these terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Entire agreement
These terms, together with our Privacy Policy, constitute the entire agreement between you and Inkling regarding the use of the app.
Force majeure
We are not liable for any delay or failure to perform resulting from circumstances beyond our reasonable control, including natural disasters, network outages, third-party service interruptions, governmental actions, or labor disputes.
No account, no profile
Inkling does not require an account, does not collect identifying information, and does not maintain a profile of you on our servers. All your data lives on your device.
